1. Definitions
General Terms and Conditions: The rules and provisions applicable to all offers, agreements, and transactions between Trend Department and consumers.
Trend Department: The company that drafts the general terms and conditions and offers products or services.
Consumer: The natural person not acting in the exercise of a profession or business who enters into an agreement with Trend Department.
Agreement: A binding arrangement between Trend Department and the consumer, established after placing and accepting an order.
Delivery: The process by which the products ordered by the consumer are provided or offered by Trend Department.
Price: The monetary amount paid by the consumer for the products or services, including VAT and any additional costs.
Cooling-off Period / Right of Withdrawal: The period during which the consumer may terminate an agreement without providing a reason and has the right to return products.
Return: The process by which the consumer sends products back to Trend Department within the stipulated timeframe and under the specified conditions.
Data Management: The manner in which Trend Department handles consumers' personal data, in compliance with applicable privacy legislation.
Warranty: The assurance provided by Trend Department that the delivered products comply with the agreement and the consumer's reasonable expectations.
Offer: A non-binding price quote or promotion made by Trend Department, unless otherwise stated.
Images and Specifications: Visual and technical information about products that are indicative only and do not constitute binding guarantees.
Force Majeure: Unforeseen circumstances beyond Trend Department's control that prevent the execution of the agreement.
Complaints Procedure: The procedure followed by Trend Department for submitting and handling consumer complaints.
Applicable Law: Dutch law, which governs all agreements and disputes with Trend Department.

3. General
3.1. These general terms and conditions apply to every offer made by Trend Department and to every agreement concluded between Trend Department and the consumer. The terms and conditions are accessible to everyone and published on the Trend Department website.
3.2. By placing an order, you indicate that you agree to the delivery and payment terms. Trend Department reserves the right to amend its delivery and/or payment terms after the expiration of the current term.
3.3. Unless otherwise agreed in writing, Trend Department does not acknowledge general or specific terms or provisions from third parties.
3.4. Trend Department guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.
4. Delivery
4.1. Delivery takes place while stocks last.
4.2. In accordance with the rules of distance selling, Trend Department will execute orders within 30 days at the latest, unless a different delivery period has been agreed upon. If delivery within 30 days or the agreed-upon period is not possible (due to the ordered item being out of stock, no longer available, or for other reasons causing delays), or if an order cannot be fulfilled or only partially fulfilled, the consumer will be notified within one month after placing the order. In such cases, the consumer has the right to cancel the order at no cost and without formal notice.
4.3. Trend Department's delivery obligation is fulfilled, unless proven otherwise, as soon as the items delivered by Trend Department have been offered to the consumer once. For home delivery, the carrier's report, indicating a refusal of acceptance, serves as conclusive evidence of the delivery offer.
4.4. All timeframes mentioned on the website are indicative. No rights can therefore be derived from the stated timeframes.
4.5. The consumer is responsible for providing accurate information when placing an order.
5. Prices
5.1. Prices will not be increased during the validity period of the offer, unless required by legal measures or if the manufacturer implements interim price increases.
5.2. All prices on the website are subject to printing and typographical errors. No liability is accepted for the consequences of such errors.
5.3. All prices on the website are in Euros and include 21% VAT.
6. Cooling-off period / Right of withdrawal
6.1. In the case of a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the consumer has the right to return (part of) the delivered goods within 14 days without providing a reason. This period begins at the moment the ordered items are delivered. Before returning items, the consumer must notify Trend Department in writing within 14 days of receipt and follow the steps outlined on the Returns & Refund page. The product must be returned unused, unopened, and well-packaged. Upon withdrawal, the entrepreneur will refund the amount paid by the consumer as soon as possible, but no later than 14 days after withdrawal. The entrepreneur will use the same payment method as the consumer used, unless the consumer agrees to an alternative method. The refund is free of charge for the consumer. If the consumer does not notify Trend Department within the 14-day cooling-off period of their intention to use the statutory right of return, the purchase becomes final. During the cooling-off period, the consumer must handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to assess its nature, characteristics, and functionality. If the consumer exercises their right of withdrawal, they must return the product to the entrepreneur within 14 days of withdrawal, following the reasonable and clear instructions provided by the entrepreneur. The consumer is only liable for any diminished value of the product resulting from handling it in a way that goes beyond what is permitted as described above. The consumer must prove that the goods were returned on time, for example, by providing proof of postage. Returns must be made in the original packaging (including accessories and accompanying documentation) and in a condition equivalent to new. If the items have been used, encumbered, or damaged in any way, Trend Department reserves the right to deduct the depreciation in value. Subject to the conditions mentioned above, Trend Department will process the refund within 14 days of receiving the return or within 14 days of receiving proof of return (provided the proof explicitly states the contents of the return shipment).
6.2. When returning the entire purchase, the full purchase amount, including any standard shipping and/or payment costs charged, will be refunded to the consumer. If the consumer opted for a more expensive shipping method than the cheapest standard delivery, the difference will not be refunded. When returning only part of the received purchases, only the purchase value of the returned items will be refunded. The cost and risk of returning the delivered items are entirely borne by the consumer.
6.3. If, after returning items, the total amount of the original order falls below a certain threshold (e.g., €50 for free shipping), Trend Department reserves the right to charge shipping costs retroactively and deduct these from the refundable amount.
6.4. The right of withdrawal does not apply to:
- Service agreements, after the full performance of the service, provided the execution began with the consumer's explicit prior consent and the consumer acknowledged that they would lose their right of withdrawal once the entrepreneur fully performed the agreement.
- Goods or services whose price depends on fluctuations in the financial market beyond the supplier's control and which may occur within the withdrawal period.
- Goods manufactured according to the consumer's specifications, such as custom-made items, or those that have a clearly personal character.
- Products with a shelf life that expires within the 14-day cooling-off period (perishable goods).
- Sealed products that are unsuitable for return for health or hygiene reasons and whose seal has been broken after delivery.
- Cosmetic products that have been opened.
- Goods or services that, by their nature, cannot be returned, for example, due to hygiene concerns or because they are prone to spoilage or aging.
7. Data management
7.1. When you place an order with Trend Department, your data will be stored in the customer database of Trend Department. Trend Department complies with the Personal Data Protection Act. See our Privacy Policy for more details.
7.2. Trend Department respects the privacy of users of its website and ensures that your personal data is handled confidentially.
7.3. Trend Department may use a mailing list in certain cases. Each mailing includes instructions on how to remove yourself from the list.
8. Warranty and conformity
8.1. The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of reliability and/or usability, and the existing legal provisions and/or government regulations in effect on the date the agreement was concluded.
8.2. Any warranty arrangement offered by the entrepreneur, manufacturer, or importer does not affect the rights and claims the consumer may assert under the law and/or the distance agreement regarding a failure in the performance of the entrepreneur's obligations.
8.3. If it becomes apparent that the delivered item is incorrect, defective, or incomplete, the consumer must notify Trend Department in writing of these defects within two weeks of discovering the defect (before proceeding with returning the item). Items must be returned in their original packaging (including accessories and accompanying documentation). Use of the item after discovering the defect, damage caused after discovering the defect, encumbrance, and/or resale after discovering the defect will void the right to claim and return the item.
8.4. If the consumer's complaints are deemed justified by Trend Department, Trend Department will, at the consumer's choice, repair or replace the delivered items free of charge. Any liability of Trend Department for damages is limited to a maximum of the invoice amount of the relevant items or (at Trend Department's discretion) the maximum amount covered by Trend Department's liability insurance in the respective case. Trend Department excludes any liability for other forms of damage, including but not limited to additional compensation in any form, compensation for indirect or consequential damages, or damages due to lost profits.
8.5. Trend Department is not liable for damages caused by intent or equivalent deliberate recklessness of non-management personnel.
8.6. This warranty does not apply if:
A) The consumer is in default with respect to their obligations towards Trend Department.
B) The consumer has repaired and/or modified the delivered items themselves or has had them repaired or modified by third parties.
C) The delivered items have been exposed to abnormal conditions, have been handled carelessly, or have been used in a manner contrary to the instructions provided by Trend Department and/or the instructions on the packaging.
9. Offers
9.1. Offers are non-binding unless explicitly stated otherwise in the offer.
9.2. Oral promises bind Trend Department only after they have been expressly and in writing confirmed.
9.3. Offers from Trend Department do not automatically apply to repeat orders.
9.4. Trend Department cannot be held to an offer if the consumer should have reasonably understood that the offer, or any part of it, contained an obvious mistake or clerical error.
9.5. Additions, modifications, and/or further agreements are only valid if agreed upon in writing.
9.6. By agreeing to the general terms and conditions, the consumer automatically agrees to the promotional terms and conditions associated with all ongoing promotions.
10. Agreement
10.1. An agreement between Trend Department and a customer is established after a placed order has been reviewed for feasibility by Trend Department.
10.2. Trend Department reserves the right to decline orders or assignments without providing a reason.
11. Images and specifications
11.1. All images, including photos, drawings, and other visuals, as well as data regarding weights, dimensions, colors, and label illustrations on the Trend Department website, are approximate, indicative, and cannot serve as grounds for compensation or termination of the agreement.
12. Force majeure
12.1. Trend Department is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.
12.2. Force majeure is defined as any external cause, as well as any circumstance that cannot reasonably be attributed to Trend Department. This includes, but is not limited to, delays or non-performance by suppliers, internet outages, power failures, disruptions in email communication, malfunctions or changes in technology provided by third parties, transportation difficulties, strikes, government measures, delays in supply, negligence by suppliers and/or manufacturers of Trend Department or its auxiliary personnel, staff illness, and defects in auxiliary or transport equipment.
12.3. In the event of force majeure, Trend Department reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part or to demand that the agreement be modified in such a way that execution remains possible. In no case is Trend Department obligated to pay any penalty or compensation.
12.4. If Trend Department has already partially fulfilled its obligations at the onset of force majeure or can only partially fulfill its obligations, it is entitled to invoice the delivered or deliverable part separately, and the consumer is obliged to pay this invoice as if it were a separate agreement. This does not apply if the delivered or deliverable part has no independent value.
13. Liability
13.1. Trend Department is not liable for damage to vehicles or other objects caused by improper use of the products. Please read the instructions on the packaging and/or consult our website before use.
13.2. Trend Department is not liable for the loss of packages or incorrect delivery of orders if the consumer provides an incorrect address when placing an order.
14. Complaints procedure
Trend Department has a clearly communicated complaints procedure and handles complaints in accordance with this procedure.
Complaints about the execution of the agreement must be submitted to Trend Department within 7 days after the consumer has discovered the defects. Complaints must be fully and clearly described.
Complaints submitted to Trend Department will be answered within 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Trend Department will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed response.
Submitting a complaint does not suspend the obligations of Trend Department unless explicitly stated otherwise in writing.
If a complaint is deemed justified by Trend Department, the company will, at its discretion, either replace or repair the delivered products free of charge.
15. Applicable law / Competent court
15.1. All agreements are governed by Dutch law.
15.2. Disputes arising from an agreement between Trend Department and the consumer that cannot be resolved by mutual agreement will be submitted to the competent court in the Amsterdam district, unless Trend Department prefers to submit the dispute to the competent court in the consumer's place of residence, and with the exception of disputes that fall under the jurisdiction of the subdistrict court.
